General Terms and Conditions of Railsformers s.r.o.

1. Introductory Provisions

1.1 These General Terms and Conditions (hereinafter referred to as the "GTC") govern the rights and obligations between Railsformers s.r.o., Company ID 24704440, with its registered office at Vřesinská 2371/33, 708 00 Ostrava-Poruba, registered in the Commercial Register maintained by the Regional Court in Ostrava on 30 June 2010, Section C, Insert 36254, (hereinafter referred to as the "Seller") and the customer (hereinafter referred to as the "Buyer").

1.2 These Terms and Conditions comply with Regulation (EU) 2022/2065 of the European Parliament and of the Council on Digital Services (hereinafter referred to as "DSA").

1.3 The subject of these GTC is the provision of services and products via the websites of Railsformers s.r.o., available at https://railsformers.com (hereinafter referred to as the "Website"), and the included systems (hereinafter referred to as the "Systems"), which include in particular:

These GTC fully apply to each of these Systems, and some of them may have additional, more detailed specifications available directly on the individual Systems’ websites.

2. Orders and Conclusion of Contract

2.1 The Buyer places an order via the Website by submitting an electronic form.

2.2 A contract between the Seller and the Buyer is concluded at the moment the order is confirmed by the Seller unless otherwise agreed.

3. Prices and Payment Terms

3.1 Prices of goods and services are listed on the Website including VAT.

3.2 The purchase price is payable upon ordering, unless otherwise agreed.

4. Delivery Terms

4.1 The Seller shall ensure delivery of goods or provision of services as soon as possible, in accordance with the agreed conditions from the moment of order confirmation.

4.2 The Buyer is obliged to accept goods/services at the agreed time.

5. Rights and Obligations of Users

5.1. The User agrees to use the above-mentioned services in accordance with legal regulations, these Terms and good morals.

5.2. It is forbidden to submit any illegal content, spread disinformation, or infringe the rights of third parties.

5.3. The User is responsible for the accuracy and correctness of the data provided to the Seller.

6. Content Moderation and Service Restrictions

6.1. The Provider reserves the right to remove content or restrict a user's access if:

  • the content violates legal regulations,
  • these Terms are violated,
  • there is reasonable suspicion of Service rules being violated.

6.2. In the event of a service restriction, the User will receive a notification specifying the reasons and the possibility to appeal.

6.3. If the User disagrees with the decision, they may submit an appeal via the mechanism specified below.

6.4. Appeals Mechanism

6.4.1. If the User disagrees with a decision to restrict content or their account, an appeal may be submitted via the Seller’s single point of contact available here: https://railsformers.com/contacts.

6.4.2. The appeal must include:

  • identification of the restricted content,
  • the reason why the User believes the decision is incorrect,
  • contact details for feedback.

6.4.3. The Provider undertakes to review the appeal, typically within 30 days, and inform the User of the outcome.

7. Withdrawal from Contract

7.1 The Buyer has the right to withdraw from the contract without giving any reason within 14 days from the date of receipt of the goods.

7.2 Withdrawal must be made in writing and sent to the Seller’s address.

8. Complaints

8.1 The Buyer has the right to make a complaint about goods/services if they are not in accordance with the contract.

8.2 The complaint must be submitted in writing to the address of the Seller.

9. Protection of Personal Data

9.1 The Seller processes the personal data of the Buyer in accordance with applicable legal regulations and the specifications set out in the Privacy Policy. More about the privacy policy of Railsformers s.r.o. can be found here: https://railsformers.com/gdpr.

10. Final Provisions

10.1 These GTC take effect as of 17 February 2025. Update: 1 July 2025.

10.2 The Seller reserves the right to amend these GTC at any time. Any changes will be announced on the Seller’s website.
